Welcome to fuly.ai (the "fuly.ai"). This fuly.ai Privacy Policy (the "Policy") explains how we collect, use, share, disclose, and process your personal data when you use https://fuly.ai/ (the "Website"), the [mobile application name], any [fuly.ai API] or third-party application that relies on this API, or any other service provided by fuly.ai (collectively, the "Services").

We have the right to revise and update this Policy from time to time, and you are responsible for reviewing it regularly to ensure you are aware of the latest version. If required by law, we will notify you of any revisions in accordance with applicable laws. By registering for or accessing the Services or Website, you accept all terms and conditions of this Policy. Capitalized terms not defined in this Policy have the meanings given to them in the fuly.ai Terms of Use.

1.Data Collection

A. Categories of Personal Data Collected

When you use the Services, we collect, process, use, and internationally transfer the data you transmit to fuly.ai through your computer, mobile phone, or other receiving device, in accordance with the purposes set out in this Policy. In addition to the personal data described here, we also collect, process, use, or internationally transfer the cookie-related information described in the Cookie Policy provided on the Website. The categories of information we may collect, process, use, and internationally transfer include but are not limited to the following:

  1. (1)Information You Provide

    You may provide fuly.ai with the following data, for example: (a) account information: your email address and password; (b) personal data: name, nationality, country of residence, date of birth, address, phone number; (c) identity verification information: including but not limited to ID number, photos of government-issued identification documents (passport, national ID card, driver's license, etc.) [, photos of the foregoing identification documents together with your selfie], and information related to the U.S. Foreign Account Tax Compliance Act (FATCA); (d) financial data: including but not limited to account number, billing, and source of funds.

  2. (2)Automatically Collected Data

    When you access or use the Services and Website over the internet, fuly.ai may use various technologies to obtain: (a) technical information: IP address, browser information, login information, operating system and platform, time zone settings; (b) browsing information: the full clickstream of URLs to, through, and from the Website (including date and time); pages you view or search; time spent on specific pages, page response times, download errors, page interaction data (e.g., mouse scrolling, clicks, hover); and methods used to leave the page. While you browse the Website, we also use (or may use) cookie technology and web beacons. For more information about cookies and web beacons, please see the Cookie Policy. (c) Geolocation information: when you use or download the Services, fuly.ai will receive real-time location information of your device.

    You may choose to provide us access to certain personal data stored with third parties, such as social media sites (e.g., Facebook, Google, Twitter, or any other third party). The data we can access may differ from site to site and depends on your privacy settings or authorization on the relevant site. If you connect a third-party-managed account to your fuly.ai account and authorize fuly.ai to access such data, we may ask you to consent to fuly.ai collecting, processing, using, internationally transferring, and storing such data in accordance with this Policy.

  4. (4)Other

    We may also collect, process, use, or internationally transfer your feedback regarding the Services or Website, or any responses to our surveys. While you use the Services, we may also collect, process, use, or internationally transfer data about your transactions and/or other activities on the Website. We may continue to collect, process, use, or internationally transfer the name and category of the computer, mobile device, or other access device you use — such as the operating system name and device — for purposes such as fraud prevention, monitoring potential misuse of accounts, and identifying malware or other activity that may harm fuly.ai and/or its users. In addition, to the extent permitted by law, we may also collect, process, use, or internationally transfer other information you voluntarily provide to our Customer Success Team.

The categories of the above personal data are: 001 (personal identifiers), 002 (financial identifiers), 003 (identifiers in government records), 011 (personal description), 031 (home and facilities), 032 (property), 035 (leisure activities and interests), 036 (lifestyle), 083 (credit rating), 102 (agreements or contracts), and other personal data categories described in the fuly.ai Terms of Use, this Policy, the Cookie Policy, other related contracts, statements, and consent forms, and any other personal data within the specific purposes and categories of personal data eligible for collection, processing, use, or international transfer under Taiwan's Personal Data Protection Act or other applicable laws.

B. Specific Purposes for Collecting, Processing, Using, or Internationally Transferring Personal Data

We collect, process, use, or internationally transfer the above information for the following purposes: (a) providing the Services and customer support; (b) evaluating and processing your applications/transactions and sending transaction-related notifications; (c) analyzing your use of the Services and Website; (d) developing and customizing the Services and Website content based on your preferences; (e) resolving disputes, collecting fees, and solving problems; (f) facilitating, operating, providing your use of, and/or managing your use of and/or access to the Services and Website; (g) sending targeted marketing materials, Services updates, and promotional offers based on your communication preferences; (h) cross-referencing your personal data with third-party databases to verify your identity.

The above purposes are: 036 (deposits and remittances), 040 (marketing, including financial holding company joint marketing), 063 (collection, processing, and use of personal data by non-government agencies pursuant to legal duties), 069 (contracts, similar contracts, or other legal relationship matters), 090 (consumer/customer management and services), 094 (property management), 135 (information/communication services), 136 (information/communication and database management), 137 (information security and management), 148 (online shopping and other e-commerce services), 154 (credit investigation), 157 (investigation, statistics, and research analysis), 181 (other businesses operated within the registered business scope or organizational charter), and any other purposes under Taiwan's Personal Data Protection Act or other applicable laws related to establishing legal relationships with you (including the fuly.ai Terms of Use, this Policy, the Cookie Policy, and other contracts, statements, and consent forms), exercising relevant rights and obligations, regulatory compliance, and exercising statutory duties.

2.Processing and Use of Personal Data; Period, Region, Recipients, and Methods of Use

A. Other Specific Purposes
  1. fuly.ai may process and use your personal data for the following purposes:
  2. (1) Providing the Services and requested customer support;
  3. (2) Processing transactions and sending transaction-related notifications;
  4. (3) Analyzing your use of the Services and Website;
  5. (4) Providing the Services and requested customer support;
  6. (5) Resolving disputes, collecting fees, and solving problems;
  7. (6) Providing targeted marketing materials, Services updates, and promotional offers based on your communication preferences;
  8. (7) Disposing of de-identified personal data;
  9. (8) Cross-referencing your personal data with third-party databases to verify your identity; and/or
  10. (9) Complying with legal requirements (including but not limited to anti-money laundering and counter-terrorism financing, or enforcing agreements between you and fuly.ai).
  11. Please note that more than one purpose may apply at any given time. The categories (classification) of personal data are the same as those described in Section 1.
B. Recipients of Personal Data

(a) fuly.ai and our branches, affiliates, other members of our group, entities to which we/fuly.ai outsource operations (the "Outsourced Entities"), entities/institutions sub-engaged by Outsourced Entities, entities with which fuly.ai contracts based on business needs (including business needs under the fuly.ai Terms of Use, this Policy, the Cookie Policy, or related contracts, statements, and consent forms), or competent authorities, judicial authorities, tax authorities, investigative bodies, and other government authorities with jurisdiction over the foregoing companies, entities, or institutions, as well as any recipient not prohibited by competent authorities from receiving internationally transferred data; (b) parties with whom we/fuly.ai are conducting or intend to conduct transactions, and which therefore need to collect, process, internationally transfer, and use personal data.

C. Period of Use of Personal Data

Whichever of the following is longest: (a) the period during which the specific purpose of collection exists; (b) the period of mandatory record retention required by applicable laws and regulations; (c) the retention period required for operational needs; (d) the retention period set out in any contract.

D. Region of Use of Personal Data

Any location, whether inside or outside the regions where the recipients of personal data described above are located.

E. Methods of Use of Personal Data

In accordance with personal data protection regulations, personal data is collected, processed, internationally transferred, and used through automated equipment or non-automated methods (e.g., electronic documents, paper, or other appropriate methods consistent with current technology).

3.Storage and Protection of Personal Data

A. We have the right to contract with third-party service providers to collect, process, use, internationally transfer, store, and/or protect your personal data.
B. We will store and process your personal and transactional information/data, including but not limited to payment-related information in Taiwan, but the location may change from time to time depending on the service providers used by fuly.ai (the "Storage Locations"). Government bodies, courts, law enforcement, or competent authorities at the Storage Locations may access your personal data. Please note that the privacy protection standards at the Storage Locations may differ from those applicable in your country of residence.
C. We employ reasonable technical and organizational information security measures to safeguard your personal data and prevent data leakage, unauthorized access, or other risks related to disclosure of personal data. However, fuly.ai cannot guarantee that personal data you provide or that we collect will be free from malicious attacks by hackers or computer experts that may result in data being accessed, disclosed, altered, or destroyed.

4.Third-Party Analytics and Advertising

A. To develop or improve the Services and Website, fuly.ai may contract with third-party service providers to assist with research and analysis of your use of the Services and Website. Such third parties may use cookies and similar technologies to obtain similar information about your use of the Services and Website.
B. fuly.ai may permit third-party ad servers or ad networks to deliver advertisements related to the Services, the Website, and third-party services. Such third-party ad servers or ad networks use specific technologies to deliver advertisements and links related to the Services directly to your browser. The third party will automatically receive your IP address. Such third parties may also use other technologies to evaluate the effectiveness of their advertisements and to deliver personalized advertising content.
C. fuly.ai cannot control the cookies and similar technologies used by these third parties. Except as otherwise required by applicable law, the third parties' use is governed by their own privacy policies and is not subject to this Policy.

5.Third-Party Analytics and Advertising

fuly.ai takes your privacy seriously. However, for the purposes of your use and our improvement of the Services and Website, we may share your personal data with the following parties in the following circumstances:

A. We have obtained your consent to share or transfer your personal data to a third party.
B. We share or transfer your personal data with necessary third parties, including but not limited to fuly.ai affiliates that assist with operations such as payment collection, marketing, know-your-customer procedures, and technology services, or other service providers reasonably determined by fuly.ai. By registering for or accessing the Services or Website, you are deemed to consent to our reasonable sharing of personal data with such parties.
C. In response to subpoenas, court orders, or similar legal processes, fuly.ai may be required to disclose personal data.
D. If we intend to sell, purchase, or merge our business with a third party, we have the right to share, transfer, or disclose your personal data to such third party. fuly.ai may also transfer or assign such personal data in the event of a corporate merger, demerger, or dissolution.
E. If we believe in good faith that disclosure of personal data is necessary to prevent personal injury or property loss, report suspected illegal activity, or investigate violations of the fuly.ai Terms of Use, we also have the right to disclose personal data.

6.Your Choices and Rights Regarding Personal Data

A. With respect to personal data collected, processed, or used by fuly.ai, you may decide whether to exercise the rights set out in this Section 6, and may decide whether to delete your account — but doing so will prevent us from continuing to provide the Services and Website to you.
B. Subject to applicable laws and the provisions of this Section 6, you have the following rights and may make the following requests to us:
  1. (1) To inquire about, request access to, request copies of, supplement, or correct the personal data collected by fuly.ai;
  2. (2) To request fuly.ai to stop collecting, processing, or using the personal data collected by fuly.ai; and
  3. (3) To delete all personal data collected by fuly.ai. Please note, however, that this may result in our being unable to continue providing the Services and Website to you. In addition, in order to comply with statutory obligations, we may be unable to delete certain personal data upon request.
C. If you submit an inquiry, request access, or request a copy of the personal data fuly.ai has collected from you, fuly.ai will inform you of its decision within 15 days of receiving the request, except in the following circumstances:
  1. (1) Where doing so may endanger national security, foreign relations, military secrets, the overall economic interest, or other significant national interests;
  2. (2) Where doing so would impede a public agency's performance of statutory duties; and
  3. (3) Where doing so would affect the significant interests of fuly.ai or a third party.
    Please note that, where necessary, we have the right to extend the foregoing 15-day response period by written notice (whether electronic or paper) to you, with the extension not to exceed 15 days. Please note also that fuly.ai is entitled to charge a reasonable fee for inquiries, access requests, or requests for copies of personal data.
D. After you request to supplement or correct personal data fuly.ai has collected from you, fuly.ai will inform you of its decision within 30 days of receiving the request, except in the following circumstances:
  1. (1) Where the accuracy of your personal data is in dispute;
  2. (2) Where the processing or use of such personal data is necessary for the performance of duties or the fulfillment of fuly.ai's legal obligations, or where prior written consent (whether electronic or paper) has been obtained from you; and
  3. (3) Where such disputes have been recorded. Where necessary, we have the right to extend the foregoing 30-day response period by an additional period not exceeding 30 days, and notify you in writing (whether electronic or paper) of the reason for the extension.
E. You may, where appropriate and as permitted by applicable law, exercise the foregoing rights by contacting us using the contact information provided in this Policy. In some cases, however — for example, deleting or stopping the processing or use of your personal data — we may no longer be able to continue providing the Services and Website to you.

7.Children's Privacy Protection

The Services and Website are not intended for individuals under 20 years of age. We do not knowingly collect such individuals' personal data; if any such data has been collected, we will delete it as soon as it is discovered.

We bear no responsibility or obligation for the protection (or lack thereof) of your personal data on such third-party websites. Nevertheless, to protect the integrity of the Website and the links provided above, we welcome your feedback on these websites.

9.No Class Action Rights

To the extent permitted by applicable law, you and fuly.ai may bring claims against each other only on an individual basis, and not as a plaintiff or member in any class, representative, consolidated, or multi-plaintiff proceeding. To the extent permitted by applicable law, both you and fuly.ai waive the right to a jury trial.

10.Amendments

To the maximum extent permitted by applicable law, fuly.ai has the right at its sole discretion to revise, suspend, or terminate this Policy at any time without prior notice to you. fuly.ai will publish the latest version of the Policy on the Website. To the maximum extent permitted by applicable law, if any revision materially limits your rights, we will notify you (e.g., by posting a notice on this page or by other means permitted by applicable law). If you continue to use or access the Services after any revision takes effect, you agree to be bound by the revised Policy.
